Clear information about using this website and booking my services.

These Terms & Conditions apply to your use of The Motherhood Collective NI website and provide general terms relating to enquiries and services offered by me, Tracy Wishart.

Some services, particularly birth and postnatal doula support, programmes commissioned by organisations and other individually arranged services, may have their own written agreement or booking terms.

Where I provide you with a separate service agreement or specific booking terms, those terms form part of our contract and will take priority for that particular service if there is any difference between them and these general website terms.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

2. Using this website

I aim to keep the information on this website accurate, clear and up to date.

However, services, availability, dates, venues, prices and programme details may change from time to time.

Information on this website is provided for general information about my services. Visiting a page, submitting an enquiry or discussing a service with me does not automatically create a booking or contract.

You may use this website for personal and lawful purposes. You must not knowingly misuse the website, interfere with its operation or use its content unlawfully.

3. My services

Services offered through The Motherhood Collective NI may include:

  • birth and postnatal doula support;
  • birth preparation and antenatal education;
  • Birth Ready with Tracy;
  • Birth Movement & Biomechanics sessions;
  • Baby Massage classes;
  • birth trauma support and 3 Step Rewind;
  • fertility and pregnancy loss support;
  • parental wellbeing programmes including Re-Find;
  • training, workshops and programmes commissioned by organisations; and
  • other agreed pregnancy, postnatal or parent wellbeing support.

Not every service is available at all times.

4. My professional role

My work is supportive, educational and practical.

Unless specifically stated otherwise, I am not acting as your doctor, midwife, nurse, psychologist, psychotherapist or other regulated healthcare professional.

Doula support, birth preparation, baby massage education, wellbeing programmes and birth trauma support do not replace medical care, maternity care or mental health treatment.

I do not diagnose medical or mental health conditions, prescribe medication or make medical decisions on your behalf.

Decisions about medical care remain between you and the appropriate qualified healthcare professionals.

If something you tell me is outside my professional scope, I may encourage you to contact your midwife, GP, health visitor, maternity team, mental health professional or another appropriate specialist.

5. Enquiries and bookings

Sending an enquiry does not reserve a date or guarantee availability.

A booking will normally be confirmed when:

  • we have agreed which service is being provided;
  • the date or relevant service period has been agreed where applicable;
  • you have received any service-specific information or agreement required for that booking; and
  • any deposit or payment required to secure the booking has been received.

Some services may require a signed agreement before the booking is considered confirmed.

For birth doula support, the detailed terms relating to availability, on-call arrangements, visits, payments and the circumstances surrounding labour and birth will be contained within your individual doula agreement.

6. Prices and payment

Prices displayed on this website are intended to make the cost of my services as clear as possible.

Where a price is fixed, I will confirm the price before you book.

Where a programme or service needs to be tailored, I may provide an individual quotation.

Any additional costs that apply to your particular booking, such as agreed travel, additional hours, bespoke resources or other requested services, will be explained before they are charged.

Once a booking has been accepted, the payment arrangements set out in your booking confirmation, invoice or individual service agreement will apply.

Prices may change for future bookings, but I will not retrospectively change an agreed price simply because my published prices later increase.

7. Deposits and advance payments

Some services require a deposit or advance payment to secure my time, a place on a programme or a period of availability.

Where a deposit is required, I will tell you:

  • the amount;
  • when it must be paid;
  • what it secures;
  • when any remaining balance is due; and
  • the relevant cancellation and refund arrangements.

Any right to retain a deposit, deduct costs or make a cancellation charge will be subject to the terms of the particular booking and applicable consumer law.

Nothing in these terms gives me an automatic right to keep money where doing so would be unlawful or unfair.

8. Your statutory cancellation rights

If you are booking as a consumer and enter into a contract with me online, by telephone, by email or away from my usual business premises, you may have a statutory right to cancel the contract within 14 days without giving a reason.

Whether that cancellation right applies will depend on the nature of the service and the circumstances in which it was booked.

Some types of service or date-specific activity may fall within an exception to the statutory cancellation rules. Where an exception applies to your booking, I will make this clear where required.

If you ask me to begin providing a service during a statutory cancellation period, I may ask you to expressly confirm that you want the service to begin.

If you then exercise a statutory right to cancel after work has started, you may be required to pay a proportionate amount for the service already provided where the law permits this.

Where a service has been fully performed during the cancellation period following the necessary request and acknowledgement, your statutory cancellation right may end once the service has been completed.

9. Cancellations and rescheduling after the statutory cancellation period

Different services require different levels of preparation and commitment of time, so service-specific cancellation arrangements may apply.

These will be explained before or when your booking is confirmed.

If you need to cancel or rearrange a booking, please contact me as early as reasonably possible.

Where a cancellation charge or deduction is permitted, it will be considered in light of the circumstances of the booking, work already carried out and losses reasonably arising from the cancellation, together with your legal rights.

I will not seek to recover the same loss twice.

10. If I need to cancel or change a service

Occasionally illness, emergency, circumstances surrounding birth work, severe weather, venue problems or another event outside reasonable control may affect a booked session or programme.

If I need to make a significant change, I will contact you as soon as reasonably possible.

Depending on the circumstances, I may offer:

  • a rearranged date;
  • an appropriate alternative where we both agree;
  • another arrangement provided for within your individual service agreement; or
  • a refund for the part of a service that I am unable to provide, where appropriate.

Any more specific arrangements relating to birth doula availability will be governed by the individual doula agreement.

11. Information you provide to me

To provide appropriate support, I rely on you giving me information that is accurate to the best of your knowledge.

Please tell me about relevant circumstances that could materially affect the service you are asking me to provide.

You are not expected to disclose information that is irrelevant to the service.

Personal and health-related information will be handled in accordance with my Privacy Policy and applicable data protection law.

12. Classes, groups and programmes

When attending a class, group or programme, participants are expected to behave respectfully towards other attendees and the facilitator.

I may set reasonable guidelines designed to support the physical and emotional wellbeing of the group.

Where you attend a session with your baby or child, you remain responsible for your baby or child throughout the session.

If you or your baby is unwell, or you are unsure whether participation is appropriate because of a medical concern, please seek advice from the appropriate healthcare professional where needed and contact me about rearranging or attending the session.

13. Organisations commissioning programmes or training

Where a charity, community organisation, statutory service, business or other organisation commissions training or a programme, I may provide a separate proposal, quotation or written agreement.

That document may contain specific terms relating to:

  • programme content;
  • number and length of sessions;
  • participant numbers;
  • venue and travel arrangements;
  • resources;
  • fees and invoicing;
  • cancellation or postponement;
  • evaluation or reporting; and
  • other requirements agreed with the commissioning organisation.

Those agreed terms will take priority for that commission where they differ from these general website terms.

14. Outcomes and results

I will provide services with reasonable care and skill.

However, pregnancy, labour, birth, recovery, infant behaviour, emotional wellbeing and family circumstances are individual and can be unpredictable.

I cannot promise a particular birth outcome, medical outcome, feeding outcome, emotional outcome or result from attending a class, programme or support session.

My role is to provide the support, information and practical care we have agreed — not to guarantee an outcome that may depend on circumstances outside either of our control.

15. Website and programme content

Unless otherwise stated, the written material, programme content, worksheets, resources, branding and original content created for The Motherhood Collective NI remain my intellectual property.

Materials provided to you are for your own personal use, or for the agreed internal use of a commissioning organisation where applicable.

They must not be copied, sold, republished, distributed, taught or reproduced commercially without my prior permission, except where the law otherwise allows.

16. Photographs and testimonials

I will not treat attendance at a service as automatic permission to use your photograph, your baby's photograph, your birth story or your testimonial for marketing.

Where I wish to publish identifiable photographs, testimonials or personal stories, I will seek appropriate permission.

How personal information is handled is explained further in my Privacy Policy.

17. Third-party websites and services

This website may contain links to third-party websites, including Google and other external resources.

These links are provided for convenience or additional information. I do not control third-party websites and am not responsible for their content, availability, privacy practices or terms.

18. Responsibility and liability

Nothing in these Terms & Conditions excludes or restricts responsibility where it would be unlawful to do so.

In particular, nothing in these terms is intended to exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

I am not responsible for decisions or actions taken independently by healthcare professionals, hospitals, maternity services or other third-party providers.

I am also not responsible for losses caused solely by circumstances outside my reasonable control where I have taken reasonable steps to manage the situation.

Any limitation or exclusion of liability in an individual agreement will apply only to the extent permitted by law.

19. Concerns and complaints

If you are unhappy with a service or believe something has gone wrong, please contact me as soon as reasonably possible.

I would like the opportunity to understand your concern and, where possible, find an appropriate resolution.

Nothing in this section prevents you from using any legal or consumer rights available to you.

20. Governing law

These Terms & Conditions are governed by the law of Northern Ireland.

If you are acting as a consumer, nothing in this section removes any mandatory consumer protections or rights you may have under applicable law.

Any dispute will be dealt with by the courts with jurisdiction under applicable law.

21. Changes to these Terms & Conditions

I may update these Terms & Conditions from time to time as my services, website or legal requirements change.

Updated terms will apply to future use of the website and future bookings.

I will not use a later website update to retrospectively alter the agreed terms of an existing booking where doing so would be unfair or unlawful.
